Registration Requirements
All bidders must register before participating in any auction on this website. Individuals under the age of 18 are not permitted to register or bid. To register, visit the Registration page (click the profile icon at the top right of any page) and provide your full name, address, phone number, and email address. Berkshire Auctions may contact registrants at its discretion to verify the accuracy of the information provided.
Bidding Agreement
By placing a bid on this website, you confirm that you have read, understood, and agreed to these Terms of Use. Once your bid is placed and accepted, and you are the highest bidder at the auction’s close, you have entered into a legally binding contract to purchase the item at your full bid price. Berkshire Auctions reserves the right to reject any bid at any time for any reason it deems appropriate. Berkshire Auctions reserves the right to remove any item from the auction at any time, even after bids have been placed.
Reserve Prices
Most auctions include a reserve price—the minimum sale price set by the seller. If you are the highest bidder when the auction ends and meet the reserve, you will receive an email notification. If the reserve is not met, the seller may still choose to accept the highest bid. All high bids not meeting the reserve price must be approved by the seller. Winning bidders are obligated to complete the purchase.
Checkout and Payment Process
Winning bidders must complete the checkout process. After winning, go to My Account > Auctions > Bids Won, or click the “Pay Now” button in your confirmation email to proceed to checkout. Select your payment method during checkout. An invoice will be sent to your registered email.
Check or Money Order: Must be mailed to the address on the invoice and received within 7 business days of auction end.
Wire/ACH Transfers: Must be completed within 3 business days; contact us at the phone number on your invoice to initiate.
Cash Payments: Accepted in person within 3 business days.
Late payments may result in account suspension.
Item Condition and Inspection
All items are sold as is, with no warranties or guarantees. Bidders are solely responsible for evaluating the condition and suitability of any item. Please review all descriptions and photos carefully. In-person inspections are strongly encouraged when available.
Payment Clearance
All payments must be made in full, and any non-cash funds must clear the issuing bank before items will be released.
Buyer’s Premium
Credit Card Payments: Subject to an 11% buyer’s premium in addition to the item price.
Check, Money Order, Wire Transfer, or Cash Payments: Subject to a discounted 8% buyer’s premium.
Sales Tax
Sales tax will be applied to all purchases in accordance with state law. If you are tax-exempt, it is your responsibility to provide the appropriate documentation to Berkshire Auctions.
Final Sale Policy
All sales are final. No refunds will be issued under any circumstances.
Liability and Representations
Berkshire Auctions acts solely as an agent for the seller and is not responsible for undisclosed damage, defects, or inaccuracies in item descriptions or photos. Bidders are expected to conduct their own research and due diligence. No disputes will be accepted for items removed from the seller’s location by the buyer or their representative.
Shipping Policy
Shipping is not provided by Berkshire Auctions. If you require shipping, you may contact our office to request coordination with the seller. However, shipping is not guaranteed and should not be expected. Buyers should be prepared to pick up items directly from the seller’s location.
